TERMS OF USE

TITLE I

1.- GENERAL CONDITIONS OF USE AND ACCEPTANCE OF THE SAME

1.1.- The General Conditions of Use of the Portal, together with the general conditions of contract governing the provision of services, and/or the particular conditions that may be established, are intended to regulate both the provision of information, as the commercial relations that arise between Bassol Optic, SL and its users. By browsing the Portal and / or by using the services included in it, you acquire the status of User. Both the navigation, and the use of any of the services of the Portal, imply acceptance as a User, without reservations of any kind, to each and every one of these General Conditions of Use, of the General Contracting Conditions that may apply govern the provision of the services offered on the Portal, as well as where applicable, the Particular Conditions that, where appropriate, may exist in relation to the provision of services.

1.2.- Bassol Optic, S.L. may at any time and without prior notice, modify these General Conditions, as well as the General Contract Conditions set forth in Title II below, and / or the particular conditions that, where applicable, are included, through the publication of said modifications in the Portal in order that they may be known by the Users, always before the visit to it or the acquisition of any goods offered in it.

1.3.- Bassol Optic, S.L. reserves the right to refuse service to any person for any reason at any time.

2.- GENERAL TERMS AND CONDITIONS OF USE OF THE PORTAL

2.1.- These General Conditions will apply both to the promotional activity and the supply of information that is carried out through the Portal and to the provision of the services offered on the Portal, in such a way that they will govern at all times both for the simple navigation through the Portal, such as for the acquisition of goods and / or the provision of services within the framework of the Portal, although these latter activities will additionally be subject to these General Conditions of Use, as well as to the applicable general contracting conditions , and the particular conditions, that in this case, could exist.

3.- INTELLECTUAL AND INDUSTRIAL PROPERTY. PROHIBITION OF HYPERLINKS

3.2.- In no case shall it be understood that any license is granted or renounced, transmission, total or partial assignment of said rights is made or any right or expectation of right is granted, and in particular, of alteration, exploitation, reproduction, distribution or public communication on said contents without the prior express authorization of Bassol Optic, SL or of the corresponding holders.

3.3.- No link to the Portal can be established from any other website without the prior and express consent of Bassol Optic, S.L.

4.- RESPONSIBILITY

4.1.- Bassol Optic, S.L. shall respond to the damages and losses that the User may suffer as a result of using the Portal when said damages are directly attributable to a malicious or negligent action of this company and the actions of the User have not caused said fault or negligence. There will not be, in any case, willful or negligent action on the part of Bassol Optic, S.L. when it proves that it has complied with the legally and statutorily established requirements and requirements and the other care and diligence required by the nature of the service.

4.2.- Bassol Optic, S.L.no is not liable for damages that may derive from, with a purely enunciative and non-limiting nature:

Inferences, omissions, interruptions, computer viruses, breakdowns and / or disconnections in the operational functioning of this electronic system or in the computers and computer equipment of Users, motivated by causes beyond Bassol Optic, SL, that prevent or delay the provision of services or navigation through the System.
  2. Delays or blockages in use caused by deficiencies or overloads of the Internet or in other electronic systems, which may be caused by third parties through illegitimate interference beyond the control of the Store and not attributable to Bassol Optic, S.L.
  3. The inability to provide the Service or allow access for reasons not attributable to Bassol Optic, S.L., due to the User, to third parties, or in cases of force majeure.

4.3.- Bassol Optic, S.L. does not control, in general, the use that Users make of the Portal. In particular Bassol Optic, S.L. does not guarantee under any circumstances that Users use the Portal in accordance with the law, these General Conditions, morality and generally accepted good customs and public order, nor that they do so in a diligent and prudent manner.

5.- OBLIGATIONS OF THE USER

5.1.- In general, the User undertakes to comply with these General Conditions of Use, where applicable, the Particular Conditions that may apply, as well as comply with the special warnings or instructions for use contained therein or on the Portal and always act in accordance with the law, good customs and the requirements of good faith, using due diligence to the nature of the service that enjoys, abstaining from using the Portal in any way that may prevent, damage or deteriorate the normal operation of the same, the assets or rights of Bassol Optic, SL, its suppliers, the rest of Users or in general of any third party.

5.2.- Specifically, and without implying any restriction to the obligation assumed by the User in general in accordance with the previous section, the User is obliged, in the use of the Portal, as well as in the provision of services to:

  1. In the case of registering, the User undertakes to truthfully provide the data provided and to keep it updated.
  2. Do not enter, store or disseminate in or from the Portal, any information or material that is defamatory, abusive, obscene, threatening, xenophobic, incites violence to discrimination based on race, sex, ideology, religion or that in any way violates the moral, public order, fundamental rights, public libertas, honor, privacy or image of third parties and in general the current regulations.
  3. Do not enter, store or disseminate through the Portal any computer program, data, virus, code, hardware or telecommunications equipment or any other instrument or electronic or physical device that is capable of causing damage to the Portal, in any of the Services, or in any of the equipment, systems or networks of Bassol Optic, SL, of any User, of the suppliers of Bassol Optic, SL or in general of any third party, or that in any other way is capable of causing any type of alteration or preventing the normal operation of the same.
  4. To properly guard the "User Name" and the "Password" that is provided by Bassol Optic, S.L. Users, as identifiers and enablers for access to the various services offered on the Portal, undertaking not to assign their use or to allow access to them by third parties, assuming responsibility for any damages that may arise from a improper use of them. Likewise, the user undertakes to notify Bassol Optic, S.L., as quickly as possible, of its loss or theft as well as any risk of access to the "User Name" and / or the "Password" by a third party.
  5. Do not carry out advertising, promotional or commercial exploitation activities through the Portal, not using the contents and in particular the information obtained through the Portal to send advertising, send messages for direct sales or for any other commercial purpose, nor to collect or store personal data of third parties.

Communications from Bassol Optic, S.L. to the User will be made according to the data provided by it when registering in the Portal.

TITLE II

1.- CONDITIONS FOR ELECTRONIC SALE. INFORMATION PRIOR TO CONTRACTING

1.1.- These general contracting conditions, together with the specific conditions that may be established, will expressly regulate the relations between Bassol Optic, S.L., domiciled at C / Doctor Dou, 19. 08001. Barcelona. Barcelona.. and with C.l.F. B61779492 and third parties (hereinafter "Users") that contract the products offered through the Store.

1.2.- These General Conditions have been prepared in accordance with the provisions of Law 34/2002, on services of the information society and electronic commerce, Law 7/1998 on General Contracting Conditions, the revised text of the General Law for the Defense of Consumers and Users and other complementary laws approved by Royal Legislative Decree 1/2007, of November 16, Law 7/1996 on the Regulation of Retail Trade, Royal Decree-Law 14/1999 regulator of the Electronic Signature and how many legal provisions are applicable.

1.3.- The use and / or acquisition of any of the products of the Store, implies the acceptance as User, without reservations of any kind, to each and every one of the General Contracting Conditions, of the General Conditions of Use of the Portal as well as in its case, to the Particular Conditions that, in its case, govern the acquisition.

1.4.- Bassol Optic, S.L. informs that the procedures to carry out the acquisition of goods are those described in these general conditions, as well as those specific ones indicated on the screen during navigation, so that the User declares to know and accept these procedures as necessary to access to the products and services offered in the Portal.

1.5.- Any modification and / or correction of the data provided by the Users during the navigation must be made according to the indications included in the Portal.

1.6.- The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user's domicile.

2.- PRODUCTS OFFERED. PURCHASE SYSTEM

2.1.- The Products offered in the Store, together with their characteristics and price, will appear on the screen. Apart from the price, and before confirming the order, the total shipping costs to the User's address will appear on the screen, which will always be paid by the buyer. The prices indicated on the screen are shown in euros and include the I.V.A. and any other tax that was applicable and will be valid at all times for the countries of the European Union. 2.2.- For the acquisition of the products in the Store, Bassol Optic, S.L. Likewise, the Client may request, and Bassol Optic, S.L. will send the corresponding invoice. The order confirmation and proof of purchase will not be valid as invoice.

2.5.- Bassol Optic, S.L. reserves the right to cancel the User Name and password, and therefore access to the Store for those users who maintain debit or unpaid balances with Bassol Optic, S.L.

2.6. - We make every effort to display as accurately as possible the colours and images of our products that appear in the shop. We cannot guarantee that the display of any colour on your computer monitor will be accurate. 2.7. - We reserve the right, but are not obligated, to limit sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. 2.8. - We do not warrant that the quality of any product, service, information or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

3. FORM OF PAYMENT, DELIVERY

To proceed with the payment, the User must follow each and every one of the instructions that appear on the screen, providing the necessary information.

As an electronic payment system, Bassol Optic, S.L., has installed an electronic commerce payment gateway. All data provided for these purposes are encrypted to ensure maximum security of them. They are hosted on a secure server certified according to the SSL protocol. Also Bassol Optic, S.L. it states that, in no case does it store in any way the data provided by the Users through the payment gateway, with the exception of those required to identify the means of payment selected by the Client.

3.2.- Bassol Optic, S.L. is obliged to deliver the goods purchased by the User, at the Buyer's address indicated for that purpose in the order form. Products will not be delivered in post office boxes or in public places other than those explicitly offered during the purchase process. The delivery period will be expressly indicated for each product, always understanding that said delivery term refers to working days, which will count from the date of confirmation of the order by Bassol Optic, SL. also on behalf of the Buyer.

3.3.- Bassol Optic is not responsible for the currency changes that your Bank or the chosen payment platform (Amazon Pay, Visa, MasterCard, Paypal, Klarna) may apply. International prices are an approximation based on the current exchange rate. All our prices are in Euros (€). There may be differences that range between 3% and 5% on the exchange rate depending on the time of purchase or the time of a return.

3.4.- If you are returning an item from outside the European Union you must ensure that all costs and expenses are prepaid. Bassol Optic is not responsible for any taxes, duties or other customs fees when the product is returned.

3.5.- CUSTOMS - COUNTRIES OUTSIDE THE EUROPEAN UNION: Some countries may have import taxes and customs costs, please check with local authorities. If the shipment of the package incurs customs duties and taxes, these will be borne by the customer. Please note that Bassol Optic operates from the European Union. If the customer does not want to take charge of customs fees, Bassol Optic will not refund the amount of the order or take charge of the package. In some occasions, the U.S. Customs Authorities ask their citizens to provide their Social Security number to release the imported merchandise.

3.6.- PARTIAL DELIVERIES: We reserve the right to send the order partially if it contains more than one item and any of them takes longer than the dates indicated in the order.

4.- WITHDRAWAL

4.1.- Right of withdrawal.

The consumer will have a period of 15 calendar days to resolve the sale, provided that the nature of the acquired good allows it. The term of 15 days established in the previous paragraph will be computed from the reception by the Buyer of the purchased goods. In any case, it will be understood that the Buyer has known the right of withdrawal from entering the Store, which requires reading and acceptance of these General Conditions, and in any case from the moment you place the order. Bassol Optic, S.L. will return the amounts received by payment, but the Buyer will bear the direct costs of return of the goods, as reflected in the Consolidated Text of the General Law of Defense of Consumers and Users, within a period not exceeding 14 calendar days once we have received notification of your decision to withdraw from the contract. In case of return of the merchandise acquired by the client, he will assume the costs of collection of the same. These expenses will be equal to the shipping costs applicable to the delivery of the merchandise. The procedure for exercising a refund is specified in section 6. The product must be in perfect condition, (with its original packaging, documentation and plastic bags) without further deterioration than that resulting from the handling of the goods to establish their nature, characteristics or operation.

The product must be accompanied by all accessories, complements and documentation if applicable.

For reasons of protection of health and hygiene, returns of personal hygiene items that have been unsealed after delivery will not be accepted.

According to the regulations of the European Union and Commercial Standards, personalized items are not subject to the right of withdrawal, that is, it is not applicable to prescription glasses and other personalized products. Once the order has been placed, it cannot be canceled. and it cannot be returned or reimbursed, as long as there is no defect attributable to Bassol Optic, in this case we will replace the item, but in no case will we return the product.

In case of shipment of contact lenses and hygiene products, the customer loses the right of return when the product is unsealed.

The return is subject to the prior checking of the product by the authorized Technical Service.

The merchandise must be delivered to our carrier in perfect condition, packed in a sealed and sealed packaging that covers its original packaging. The product must be perfectly identified and marked with the order number provided by the Customer Service Department.

4.2.- Consequences of the withdrawal.

In case of withdrawal, we will refund all payments received from you, excluding delivery costs, without any undue delay and, in any case, no later than 15 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make such refund using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; In any case, you will not incur any expenses as a result of the refund. We may withhold reimbursement until we have received the goods, or until you have submitted proof of the return of the same, depending on which condition is met first.

We will collect the goods or, you must return or deliver directly the goods in our facilities, without any undue delay and, in any case, no later than within 15 calendar days from the date you notify us of your decision. withdrawal of the contract. The deadline will be considered fulfilled if the goods are returned before the end of that period.

You must assume the direct cost of returning the goods. It is estimated that this cost rises to approximately the cost, in euros, of the shipment of the goods.

You will only be responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and operation of the goods.

4.3.- Restocking fees.

If your order is for 4 or more items, you must keep at least 25% of your order to avoid a restocking fee. The restocking fee is 10% of the total value of the cart. For example, if you order 8 items for a total cost of €800 and retain only one item, then there is a restocking fee of €80 in addition to the price of the unreturned item. We therefore recommend that you order 3 items. Please note that this applies to orders per week, therefore multiple orders in a week will be treated as one order and will be subject to the above fee. This rate applies due to non-refundable bank fees and other associated costs.

5.- DEFECTIVE PRODUCT

If the product is defective, Bassol Optic, S.L. will be responsible for the replacement of the product, without any expense to the client.

If the product arrives in poor condition due to transportation, the user must indicate it on the delivery note of the carrier and call within 24 hours of receipt to our Customer Service to make the claim.

6.- CANCELLATIONS AND RETURNS

6.1.- Cancel an order

An order can be cancelled as long as it has not been shipped at the address you have specified. If you wish to cancel an order that you have already received, please check the "Return an order" section. Once the order has been shipped it is not possible to cancel the order or delivery.

If you have placed an order and want to cancel it, just send us an e-mail to [email protected] and indicate the cancellation. Within 24-48 hours we will make the cancellation and refund the corresponding amount by the initial payment method.

a) If we have not yet sent your order, it will be cancelled and no charge will be made.

b) If you have already received it at your address, you must follow the procedure established for the returns.

Remember that the refund of the amount of the charge will always be made in the same medium that you have used for the payment.

6.2.- Returning an order

Return conditions

If the product purchased does not convince you at all, you can request a refund or change it. You have a time period of 15 days from the delivery of the order. To proceed with this, you must ensure that a series of essential requirements are met so that we can process and accept your return.

The product must be in perfect condition, with its original packaging without deterioration, including plastic covers and protectors.

The product must be accompanied by all accessories and accessories and documentation if applicable.

For reasons of protection of health and hygiene, returns of personal hygiene items that have been unsealed after delivery will not be accepted.

Customized products requested by the customer and similar can't be returned and refunded unless they have manufacturing defects. Manufacturing defects of these products must be reported to us within 24 hours.

Bassol Optic, S.L. always check, before accepting the return, that these conditions are met. We will not accept any return that does not comply, in which case we will return the product.

If the product arrives in poor condition due to transportation, you must refuse the delivery, indicate it on the delivery note of the carrier and contact our Customer Service to manage the incident. If you identify this problem once you have accepted the delivery of the order, you must call within 24 hours of receipt to our Customer Service, to make the claim. After this term Bassol Optic, S.L. will not be responsible for any claim for this reason.

Remember that the refund of the amount will be made in the same form of payment that you have chosen when placing the order.

Please note that if you are returning an item from outside the European Union you must ensure that all costs and expenses are paid in advance. Bassol Optic is not responsible for any taxes, fees or other customs fees when the product is returned.

Steps to follow to process the return

If your order meets the return conditions, you must follow the following steps:

Order number and date of purchase.

Product you want to return and reason for the return.

The product to be returned must be properly packed and protected with the original box.

  • Paso 3: COLLECTION OF THE PRODUCT.

Bassol Optic only offers product collection in the event of an error in the processing of the order or a manufacturing defect. Bassol Optic, S.L. does not accept any return postage due.

  • Paso 4: CHECK.

Once the product has been collected and received at our facilities, we will proceed to verify that the return is in accordance with the established conditions.

If the product does not meet the conditions of return, it will not be paid and we will contact you to indicate it and proceed to return it in the same state in which you have sent it to us.

  • Paso 5: REIMBURSEMENT.

Once proven that the return is in accordance with the established conditions, we will proceed to make the refund in the same means of payment used by you for the initial transaction within a maximum period of 15 calendar days from the date on which we reported the decision to make the return.

Delivery and collection expenses

In case of return, we will refund all payments received from you, except delivery charges.

In the case of a refund due to shipping errors or other causes attributable to Bassol Optic, S.L., the collection will be made at no cost to you and in the place you indicate. In the rest of the cases, the User will assume the return expenses. These expenses are normally, similar or equal to the shipping costs of the original order.

In the case of international refunds, Bassol Optic is not responsible for the exchange rate applied by your bank, even if the product has not been delivered.

7.- WARRANTIES

MANAGEMENT OF WARRANTIES.

Warranties are regulated by DIRECTIVE (EU) 2019/771 OF THE EUROPEAN PARLIAMENT and are a consumer right.

The warranty does not cover normal wear and tear, including scratches on the lens or accidental breakage of the frame, products that have been modified or altered, defects and damage due to improper storage conditions or non-compliance with the instructions for use of the product or technical documentation provided by the manufacturer.

In all cases, the consumer has a minimum two-year guarantee on the products and in many cases this is extended to 3 years.

The legal guarantee, which is the one we are going to focus on, has several advantages for consumers, the main ones are:

7.1. The warranty period begins on the date of delivery and lasts for three years. In order to be able to make a warranty claim within this two-year period, you only need to keep a proof of purchase with us. An official brand warranty is not required. Having any of the following is sufficient: Bassol Optic order number, order confirmation email, Bassol Optic invoice or email address you used to place the order.

7.2. If the goods delivered are defective or their warranted characteristics are deficient or defects develop during the warranty period due to incorrect manufacture we will repair the goods in question or provide you with a replacement. We are authorised to carry out multiple repairs.

7.3. All claims must be made in writing and any defects must be reported to us without delay as soon as they become apparent, otherwise you may lose your right to the warranty.

7.4. If you believe that an item you have purchased from us shows signs of a defect, please notify us by e-mail to [email protected]. This email must include photos or videos where the defect is clearly visible. Our opticians will carefully analyse the defect and give you an answer as to whether it is a manufacturing defect.

7.5. If the defect cannot be considered a manufacturing defect, we will bring it to your attention before you send the item in order to prevent you from spending time and money on a warranty claim.

7.6. If the item is found to be defective we will bear the shipping costs to return the item to the manufacturer and to send you a new item. Please note that this only applies to orders within the European Union. For items purchased from outside the European Union you will have to send us the item free of customs and import duties.

7.7. Once we have received the returned goods, we will either repair them or request a replacement. As a general rule, and in accordance with EU rules, you may only request a partial or full refund when it is not possible to repair or replace the goods.

7.8. Although we will handle any warranty procedure as quickly as possible, warranty claims may take weeks to resolve as they depend on the manufacturer's timing.

7.- 8.- EXCLUSION OF LIABILITY

The Proprietor shall in no event be liable for any damages caused to the Buyer by any cause attributable to the Buyer. Óptica Bassol shall only and exclusively be liable for any damages caused as a result of the purchases made on the Website, provided that they are derived from a fraudulent or culpable action on the part of the Purchaser.

By way of example only, Optica Bassol shall not be liable for:

8.1. The usefulness for the Buyer have the products that would have acquired, since at no time the Holder is responsible for the selection made, even if you identify items in combination with the selected products, which by their nature are recommended as accessories and / or complements.

8.2. Personal injury or material damage caused as a result of the use of the products, provided that the recommendations specified therein have not been followed.

8.3. Failure to comply with its obligations for reasons of force majeure such as, but not limited to, internal or external strikes, natural catastrophes, social unrest, etc.

8.4. The Purchaser thus acknowledges that he/she acquires the articles at his/her own risk, the activity of Optica Bassol being limited to the execution of the material tasks necessary for delivery, processing and management.

8.5. In any case, the liability assumed by Optica Bassol against the Buyer, in no case includes lost profits and shall be limited, at most and for any reason, to the total amount received by Optica Bassol of the Buyer in consideration for the purchase of the product in accordance with these Conditions.

9.- PURCHASE OF REPLACEMENT PRESCRIPTION GLASSES

Replacement prescription glasses are limited to a product with the same technical specifications prescribed for the prescription glasses that you have previously purchased as a result of the measurement and subsequent prescription issued by your optician or ophthalmologist.

By placing your order on our website, you confirm that the prescription glasses have been prescribed in advance by your optician or ophthalmologist and that the fitting has been well tolerated without any exceptions.

If this is your first purchase of prescription glasses, or if it has been more than one (1) year since your specialist last checked your vision/grading, we recommend that you ask your optician or ophthalmologist for a diagnosis prior to purchase, as indicated by the General Council of Colleges of Optometrists in its Manual of Good Professional Practice.

In order to purchase your replacement glasses, you will need to provide us with the following information prescribed by your specialist, so that the lenses of your replacement glasses are identical to those prescribed: Sphere | Cylinder | Axis | Addendum | Addition

This data may be considered as health data. With your purchase you give us your express consent to access and use this information for the purpose of selling replacement prescription glasses. For more information, please see the Privacy Policy published on this website.

You will also need to provide us with information for the physical characteristics of the replacement prescription glasses: Interpupillary distance | Nasopupillary distance.

In the event that we cannot guarantee that your replacement prescription glasses will have lenses identical to those prescribed by your specialist, we will contact you.

Bassol Optic will do everything possible to process your order. However, we reserve the right not to provide replacement prescription glasses because the specifications provided by you are not clinically suitable. 

You are responsible for the accuracy, truthfulness and correctness of the prescription data you have requested from us for the purchase of replacement prescription glasses. In the event that you do not fit your replacement prescription glasses because of the specifications you have provided us with, Bassol Optic shall not be liable.

We inform you that the purchase of personalised items, such as replacement prescription glasses or non-prescription glasses with blue filter, are strictly excluded from the right of withdrawal.
